Mandatory helmet rule for pillion riders comes into effect in Kerala

Starting Sunday, December 1, helmets are mandatory for pillion riders in Kerala. This is in accordance with the Union government’s amendment to the Motor Vehicles Act in August this year. As per the rule, all two-wheeler riders including pillion riders over the age of four have to wear a helmet.  The Motor Vehicle Department (MVD) and the police in the state are jointly working to make sure that the amendment is implemented. "We are making sure that it's strictly followed. The response so far on the first day has been fairly good,” Superintendent of Police Traffic ( South) Johnykutty KL told TNM. “How effectively it's being followed in the coming days, we’ll have to see. Considering it’s a Sunday, there are fewer two-wheelers on the road.”  On Sunday, the MVD and police personnel restricted their action on those who failed to follow the rules, letting them off with just a warning. A fine will be imposed in the coming days on those who breach the law, officials said.  On November 19, the state government informed the Kerala High Court that the Union government's amended rules will be implemented in Kerala.  The state government had earlier challenged a single bench order of the HC imposing the helmet rule for pillion riders. A division bench of the Kerala High Court had earlier rejected the appeal filed by the Kerala government asking it to submit within a week its stance on imposing the Union government's rules. The court also said that it would be forced to issue a circular enforcing the rules if the state fails to do so, adding that exemption cannot be granted for Kerala alone when a Union government law exists.
